What sort of matters can I get advice about?

Our family department can advise you about pre-nuptial agreements, divorce, legal separation and all legal aspects of disputes about children. If you are unmarried and living with somebody and you would like to know your legal position, we can advise you on your rights and responsibilities.

 

If we decide to divorce, how will I know what I’m entitled to?

First, we will look at all the assets owned by you and your partner, give you advice on how they should be divided up and how you can reach an agreement over them. We can help you with areas such as maintenance, child support and pensions. And when an agreement is reached, we can obtain the court orders needed to put it into effect.
 

We need some time apart but I am worried about financial support.

If you decide to separate, we can prepare a Separation Agreement setting out the matters which have been agreed between you, including terms of financial support. If necessary, you can go to court to make sure your partner sticks to the agreement.
 

I am worried that the children might suffer. How can you help?

Divorce or separation can be very difficult for your children. You need to consider who the children will live with, maintenance, contact and visiting rights. If there is a dispute over any of these matters, we can advise you on your rights as a parent and help you solve the problem through negotiation or, if necessary, through the courts.
 

Can you help with domestic violence?

Sadly, relationships can become violent. No one should have to suffer violence. We can help you (and your children) to get protection. In cases of emergency we can apply to the court for an immediate injunction to provide you with the protection that you need.
 

How much will it cost me?

Our experts will usually be able to give you advice on your best course of action - often for nothing. As no two cases are the same we will advise you about possible ways forward - after that it’s up to you. If you decide to take things further, you may be entitled to Legal Services funding (formerly Legal Aid), which will pay towards your legal costs. If you are not entitled to Legal funding we can give you details of the likely costs.
